Welcome to CareCall. These Terms of Service ("Terms") govern your use of the CareCall service. By creating an account or using our service, you agree to be bound by these Terms.

The Service

CareCall provides an AI-powered phone check-in service that makes daily wellness calls to elderly individuals on behalf of their family members or carers. The service includes:

• Daily AI-powered phone calls to nominated seniors
• AI-generated call summaries delivered by email
• Missed-call alerts to designated care circle members
• A dashboard to manage seniors, care circles, and call settings

Account Registration

To use CareCall, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration.

Subscriptions and Billing

CareCall offers a 14-day free trial with 30 call minutes, followed by a monthly subscription to a plan with a set number of call minutes. Your subscription will automatically renew each month unless you cancel. Payments are processed securely by Stripe. You may cancel your subscription at any time through the billing section of your account.

We do not offer refunds for partial months except where required by applicable law.

Consent to Calls

By adding a senior's phone number to CareCall, you represent and warrant that:

• You have the authority to arrange for the senior to receive calls from CareCall
• The senior has consented (or would consent, in the case of individuals with cognitive impairment where you have appropriate authority) to receiving daily AI-powered wellness calls
• The phone number provided is correct and belongs to the intended senior

Acceptable Use

You agree not to:

• Use CareCall for any unlawful purpose
• Provide false or misleading information about the senior or their phone number
• Attempt to reverse-engineer, hack, or disrupt the service
• Use the service to harass or harm any individual
• Resell or sublicense access to the service

Limitations of the Service

CareCall is a wellness check-in service and is not a substitute for medical care, emergency services, or professional caregiving. CareCall does not provide medical advice, diagnosis, or treatment. In the event of a medical emergency, please contact emergency services immediately (000 in Australia).

CareCall cannot guarantee that calls will always be completed or that technical issues will not arise. We recommend maintaining other channels of contact with your elderly loved ones.

Intellectual Property

The CareCall service, including its software, design, and AI systems, is owned by CareCall and protected by intellectual property laws. You may not reproduce, modify, or distribute any part of the service without our prior written consent.

Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, CareCall shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to the service or other users.

Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes become effective constitutes your acceptance of the updated Terms. We will notify you of significant changes by email.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
